Guidelines from Government for the Landlord and Tenants during COVID-19 Lockdown

As we know that due to Coronavirus (COVID-19), the whole of the world is disturbed. If we talk about India, there are confirmed COVID-19 cases daily increasing. Due to the increasing cases, a lockdown of 21 days has been announced by our Prime Minister Narendra Modi in India. Due to this COVID-19 lockdown, many people such as workers, labourers, students, etc. are facing a problem. Thus state government and central government are urging Landlords to not ask their tenants for rent during this lockdown period.

NOTIFICATIONS BY THE GOVERNMENT:
  1. Union Home Minister Amit Shah spoke to Delhi Commissioner of Police and asked him to take strict action against landlords asking doctors and nurses who are treating COVID-19 patients to vacate residences. Shah's directive comes after woes of the medical personnel surfacing on Twitter and Facebook.

  2. Amidst the Coronavirus Outbreak, the Ministry of Home Affairs (MHA) has issued an order which stops landlords from demanding rent from students, workers and migrant labourers for a month. Those landlords who force people to vacate their houses will face action, the statement warns.

  3. Delhi chief minister Arvind Kejriwal on Sunday made another appeal to migrant workers fleeing the national capital to stay put where they are, going on to assure the landlords that the Delhi government would pay them their rent if the tenants failed to do so. "If someone is not able to pay the rent and is poor we assure them that Delhi government will compensate you for the same," the Delhi CM said in a video message broadcast across major news channels.

  4. District Magistrate of Gautam Budh Nagar, BN Singh, has issued an order to all landlords in his area, saying they can ask for rent from tenants only after a month. According to the order, no tenant can be asked to vacate a house on the ground of failure to pay rent. "Landlords in Gautam Buddha Nagar can take rent from workers (tenants) only after a month. No exodus of workers on rent ground will be allowed in present circumstances. Please ensure and cooperate," said Singh in a tweet.

RIGHTS OF TENANT:

A tenant has certain rights which are protected by the law in India. He can approach the court and seek a legal remedy in case of illegal eviction by the landlord.
