The odd-even rule in Delhi: A detailed approach

Delhi is witnessing the third edition of the odd-even scheme from November 4 till November 15, 2019. As per the scheme, the odd-numbered vehicles will be allowed on the streets of Delhi on odd dates and even-numbered vehicles will be allowed on even dates. On violation of the said scheme, a challan under Section 115 of the Motor Vehicle Act is issued. Here are few frequently asked questions answered for understanding.


What is Section 115 of the Motor Vehicles Act?

Section 115 of the Motor Vehicle Act provides power to the State Government or any authority authorized by the State government power to restrict the use of vehicles in public interest or safety and convenience, or because of the nature of any road or bridge. According to this section, the driving of motor vehicles or any specific class or description of motor vehicles in a specified area for a specific time could be restricted.


What is the fine for violation of odd-even policy?

Challan, as earlier listed for the violation, was charged at Rs. 2000 but Delhi Government has now moved it up to Rs. 4000. The hike in the penalty for violation of Odd-Even scheme has been suggested by the Transport department as per the amended Motor Vehicle Act. 


Can someone be challaned twice in a day?

No! A challan for violation of Section 115 of the Motor Vehicles Act can be issued only once in a day.


Is the rule applicable on two-wheelers as well?

No, two-wheelers will be exempted. Also, the vehicles used for medical emergencies and vehicles carrying school children in uniform are exempted. Women driving alone, cars having all women as occupants and women accompanied by children aged less than 12 years will also be exempted.


Are government employees exempted from following this scheme?

Vehicled of the Prime Minister of India, the President, Chief Justice of India, Speaker of Lok Sabha, deputy speaker of Lok Sabha, deputy chairman of Rajya Sabha and Union Ministers, state governors, Supreme Court Judges, High Court Judges, Chairman of UPSC, chief election commissioners and CAG and lieutenant-general of NCT/Delhi will be exempted. However, no exemption is provided for the vehicles of Delhi Government Ministers and the Chief Minister of Delhi himself. Even the CNG will not be exempted this time as opposed to the previous Odd-Even scheme.


Will a car which is in violation of this scheme allowed to be parked anywhere?

There are designated areas in metro stations where such cars shall be allowed to be parked. 


Why CNG vehicles will not be exempted this time?

There was a lot of misuse of CNG stickers in the previous Odd-Even scheme and thus the government has decided otherwise this time. 


Is the fine applicable to cars of other states as well?

Yes, any car crossing into the borders of Delhi shall face similar repercussions on violation of this scheme.
