It is to be kept in mind that each province and territory within Canada has its own limitation periods for different categories of claims. Several of the common law provinces, including Ontario, have adopted a basic limitation period of two years for claims in contract and tort, subject to discoverability. Ultimate limitation periods vary widely across jurisdictions, ranging up to 30 years (and certain claims are not subject to any ultimate limitation period) In Québec, specific enactments establish various limitation periods (known as prescriptions), but generally claims for infringements of personal rights must be brought within three years.
