Banks in India have another platform (besides filing civil suit in a court) for recovery of amounts due to them by Indian borrowers. Recovery of debts due to Banks and Financial Institutions Act, 1993 (Act 51 of 1993) (RDB Act) has set up Debt Recovery Tribunals for recovery of outstanding amounts by Banks. Since your bank has branches in India, it can be assumed that the Bank is a Bank as defined under section 2(d) of the RDB Act. Your bank can thus file an application in the prescribed form to the Debt Recovery Tribunal having jurisdiction of the area where the registered office of the Company is situated.
