The Arbitration Act governs Arbitration in India, including, typically, statutory arbitrations. The UNCITRAL Model Law on International Commercial Arbitration 1985 is the basis for the Arbitration Act. However, the recent amendment to the Arbitration Act departs from UNCITRAL Model Law and is an attempt to deal with some of the lacunae which were found in the operation of the law. Certain other laws, such as the Electricity Act, contain mandatory provisions for arbitration. In all other cases, arbitration agreements must be entered into by the parties.
