Hi Vasudha, In india a NGO can be opened by registering under either of the following- 1. Indian truts act, 1882 as a charitable trust, and 2. companies act of 2013: under section 8 of the act opening a non profit company. Documents required would be- 1. registration certificate of a trust, society or a non profit company 2. address proof and identity proofs of trustees 3. proof of registered office 4.MOA 5.income tax and annual account details 6. proof of payment of fee 7.trust deed if any, duly notarised 8. passport size photographs opening a NGO an be a lengthy process as you need to clearly state out the non profit objectives.

with regard to the custody of the child, since he is only 3 years old the case highly favors you as it is best considered by the courts for initial years custody to be with the mother. other things which can be done is to resort for a mutual agreement with the husband as to the custody of child, if there is no agreement court will judge and rule in favor of the party which shows best in the interest of the child. also it is possible to opt for child custody without going for divorce proceedings, as mentioned under section 9 of the Hindu marriage act, 1955 if the spouse has opted out of the society of other, an application for restitution of conjugal rights can be filed.
